Within 90 days after receiving a complete application for master use permit renewal, the city shall issue a written determination granting or denying the renewal application in whole or in part. Prior to granting or denying the renewal of a permit under this chapter, the city council shall make a decision based upon the following standards. If the renewal application is denied, the written determination shall include the reasons for nonrenewal:

A. The financial and technical ability of the applicant.

B. The continuing capacity of the rights-of-way to accommodate the applicant’s existing facilities.

C. The applicant’s compliance with the requirements of this chapter and the expired master use permit.

D. Applicable federal, state and local telecommunications laws, rules and policies.

E. Such other factors as may demonstrate that the continued grant to use the right-of-way will serve the community interest. (Ord. 1053 § 1, 2006).
