Each master use permit granted pursuant to this chapter is subject to the city’s right, which is expressly reserved, to annually fix a fair and reasonable compensation to be paid for the right to occupy and use the public ways of the city granted under such permits; provided, nothing in this chapter shall prohibit the city and a permittee from agreeing to the compensation to be paid. State and federal prohibitions or preemptions may apply, and this provision shall be interpreted to conform to such state or federal restrictions. (Ord. 1053 § 1, 2006).
